POMERANIANS LIFE IN THE OUTBACK PUPPY SALES AGREEMENT
This Puppy Sales Agreement (referred to as the "Agreement") is made between the "Breeder/Seller" and the "Buyer" concerning the sale of a "Puppy" as described below: You agree that all statements and claims made by you in this contract, the Puppy Expression of Interest form, and in any communications with the seller/breeder via text, phone, email, or social media on any platform are accurate to the best of your knowledge.
Seller’s Representations and Warranties:
The Seller affirms and assures the Buyer that: (a) The Seller is the rightful and legal owner of the Dog and has the full rights and authority to sell the Dog. (b) The Dog is being sold without any encumbrances, liens, security interests, or charges. (c) At the time of sale, the Dog is in good health and free from communicable diseases. The Buyer has a 2-day grace period following the delivery date to have the Dog examined by a licensed veterinarian, at the Buyer's expense. If the examination fails and is accompanied by a written statement from the veterinarian, the Buyer may return the Dog for a full refund. Failure to have the Dog examined within this 2-day period will void this warranty. If the Buyer decides to keep the puppy, no replacements will be provided, and all subsequent medical expenses and treatments will be the sole responsibility of the Buyer. This health guarantee will not cover Cherry eye, Entropion, Ectropion, Allergies, undescended testicles, loose knees or hips, Stenotic nares, elongated soft palate, umbilical hernia, and dermatitis.

Prior to handing over the dog, a series of essential steps have been taken to ensure the well-being and seamless transition of our beloved pet:
Health and Well-being:
Regular worming every 2 weeks for the dog's health. A comprehensive vet check successfully passed at 6 weeks of age, confirming the dog's excellent health and absence of underlying medical issues. Administration of all necessary vaccinations to protect the dog from common diseases and establish immunity. Completion of a meticulous health program, which includes routine check-ups and vaccinations, to safeguard the dog's long-term well-being.
Adaptation and Growth:
Introduction to gentle handling, fostering a positive relationship between the dog and humans. Initiation of toilet training to facilitate a clean and suitable living environment. Gradual weaning off the mother's milk, marking an essential step toward independence and growth. Commencement of the transition to solid food to encourage a well-balanced diet and healthy eating habits.
Additional Preparations:
Microchipping with accurate owner information to facilitate identification and tracking in case of loss. Provision of complete health records, including vaccination history, deworming records, and relevant medical information. Consideration of spaying/neutering to promote responsible pet ownership and prevent unwanted litters. Protection against external parasites through flea and tick prevention measures. Guidance on the dog's dietary needs, feeding schedule, and any special dietary considerations. Information about grooming requirements, if applicable, along with necessary grooming tools and supplies. Advice on training and socialisation, especially for puppies, with some starting basic training or exposure to different experiences. Provision of emergency contact information for ongoing support and guidance. Planning for a gradual transition of the dog's food if dietary changes are necessary. Completion of any required legal documentation, including adoption or sale paperwork and care-related agreements. Provision of essential supplies such as if included in sale a collar, leash, ID tag, food and water dishes, toys, and a comfortable bed. A final health check by a veterinarian shortly before the handover to ensure the dog is in optimal health. These comprehensive measures have been taken to ensure the well-being and successful integration of our cherished dog into their new home.

Balance Due Date: 3 days before delivery, pick-up, or release of the dog to a transport company I understand that this deposit is for a puppy with non-breeding rights, and I acknowledge that these funds will not be refunded under any circumstances if I change my mind, back out, or if I am unable to afford the remaining total at 8 weeks of age. All payments for puppies must be made in full by the weaning date, which is at 8 weeks of age. We will maintain continuous communication to discuss homecoming dates and payment deadlines. I also understand that once I have selected my puppy, I cannot change to a different one, even if I find another puppy in a different litter that I prefer. Doing so will result in the forfeiture of my entire deposit for the selected puppy.
PAYMENT INFORMATION:
Deposit: The Buyer must submit a non-refundable deposit of $500 to the Breeder/Seller to secure the purchase of the puppy. Please note that the deposit is necessary to reserve the chosen puppy, and the reservation will be confirmed once the deposit payment clears in our account.

Purchase Price: The total purchase price for the puppy is as previously mentioned. Delivery Fee: In cases where puppy delivery is arranged, the Buyer shall pay the agreed-upon delivery fee directly to the transportation company or into the aforementioned account, per the agreement between the Buyer and the transportation company. Extended Stay Fee: If the puppy's stay goes beyond the initially scheduled pick-up, delivery, or handover date, the Buyer must pay an extended stay fee of $45 per day for each additional day. Prompt payment of the extended stay fee is expected upon notification by the Breeder/Seller.
DESSEXING REQUIREMENT:
The Buyer commits to ensuring the desexing of the puppy by the age of 6 months ( or 12 months in some cases as per vet advice ). Additionally, the Buyer agrees to provide a veterinarian's report confirming the desexing procedure and the puppy's microchip number, which must match the number specified in this contract. Failure to comply with this desexing requirement will result in a penalty charge of $8,000 per puppy produced, enforceable to the fullest extent of the law.
REGISTRATION:
The Seller certifies that this puppy complies with Australian breading standards and, Right Paw requirements, and Dogs SA mandates.
HEALTH GUARANTEE:
The puppy is considered healthy at the time of sale, as verified through a vet check prior to transitioning to its new home. The Buyer is strongly encouraged to schedule a veterinary examination within 48 hours of purchase. If a significant health issue arises within a specified period, the Buyer may be eligible for a refund or replacement.
ADDITIONAL PROVISIONS AND TERMS OF SALE
The puppy is sold exclusively for domestic companionship and must not be used for breeding, guarding, or aggressive purposes. The Buyer agrees to provide the necessary care, including veterinary attention, proper nutrition, and socialisation. The Breeder retains the right to inspect and ensure the puppy's welfare. The Buyer must promptly inform the Breeder of any changes in contact information or address. If the Buyer can no longer keep the dog, the Breeder has the "right of first refusal." In the event of legal action due to a contract breach, the Breeder is entitled to recover incurred costs and expenses. The Buyer may choose to microchip the puppy with the Breeder's contact information. The Buyer agrees to follow pet-related requirements, including spaying/neutering and participation in socialisation classes. Breach of contract terms, such as unauthorised breeding, may result in the Breeder reclaiming the dog. For health issues within the initial period, the Buyer may return the puppy for a refund or replacement. The Buyer has a 3-day grace period for returning the puppy for non-health-related reasons, with exceptions for transportation expenses, deposit, and a $1000 rehoming fee. Dog would need to pass a vet check at buyers expense.
The Buyer agrees he/she is not acting as an agent of any pet store, dealer, wholesale outlet, puppy mill, guard dog business, or research facility, and will not sell, consign, give away, or place this dog or its progeny with an aforementioned facilities If the Buyer is unable, or unwilling, to keep the dog or provide an appropriate home in accordance with this agreement due to any reason, including the death of the Buyer, full ownership will revert back to seller. unless other arrangements have been discussed with seller. Buyer releases Seller from any and all liability, costs, or damages caused by the puppy/dog after placement with the Buyer, including damage or destruction of property and injury to any person. Buyer accepts the risks and responsibilities of training the puppy/dog and acknowledges that they have sole responsibility for ongoing, lifetime socialisation and training as appropriate for the puppy/dog's age. Temperament is a product of many things, not simply genetics, and Buyer accepts that much of a dog's temperament or eventual adjustments is determined by the skill and patience of its owners) and how it is raised or integrated into the new home/situation. Buyer agrees to be very careful of over exercising the puppy/dog. No hard jogging, no exercising to the point of exhaustion, no taking the pup for long walks until after the pup is 12 months old, etc. Around the block is fine, a 5 Kilometres walk is not fine. Buyer must continue scheduled vaccinations/preventatives/deworming on time, in order to protect the puppy. The Buyer must keep vaccination/medical records from their licensed veterinarian. The Buyer assumes all responsibility for any veterinarian bills, under no circumstances will the seller be responsible for any veterinarian bills acquired by the Buyer for this puppy/dog. In the event of early death of the puppy/dog, a formal necropsy is required and results must be submitted to the Seller. Buyer is responsible tor a necropsy expenses All sales are final with in the grounds of this contract. While we strive to provide guidance on your puppy's potential outcomes, such as color and temperament, we draw upon our extensive experience to offer insights into these aspects. It's important to understand that these characteristics are influenced by nature's marvels, and we have no control over the final result. Please be aware that the seller assumes no responsibility for the ultimate outcome. Nature has its own course, and while we can offer our expertise and advice, the final attributes of your puppy are beyond our influence.
EXTENDED STAY FEE:
If the puppy's stay exceeds the originally agreed pick-up date, delivery, or handover date, the Buyer is required to pay an extended stay fee of $45 per day for each additional day. After an unarranged or extended stay of 3 days, the Breeder reserves the right to resell the dog, with no obligation to provide refunds, regardless of previous payments made.
DEMODOCTIC MANGE AND OTHER HEALTH ISSUES:
The Seller will not facilitate a puppy replacement for Demodectic mange, heat stroke, abuse/neglect, or insufficient socialisation. The Buyer acknowledges having conducted thorough research on the Pomeranian breed, including awareness of potential health issues. The Buyer is responsible for all medical expenses related to the puppy, and no refunds will be issued for health-related concerns.
